• This is not a suitable venue to host social gatherings beyond the agreed upon occupancy of the home (those named earlier in this form)
• At all hours, outdoor noise should be kept to a minimum and indoor noise shall be such that it cannot be heard in adjacent homes or outside the home.

• Unless otherwise set by the platform on which the rental was booked (Airbnb, VRBO, etc.), all accepted reservations are non-refundable and non-changeable for any reason.

• No smoking of any kind is allowed anywhere on the property, inside or out. No tobacco products of any kind are to be used in the house.

1. Please refer to your reservation confirmation for the dates of your stay, rental rate, fees, security deposit and name/location of the home.


2. Only those individuals listed by name below are permitted to be at the home at any time during your stay. Additions to this list can be approved by the Host by email or text message.

3. RENT PAYMENT:

   Payment, including security deposit (if applicable), is due in its entirety at the time of reservation. Unless a payment has been received and accepted by the Host, the Host may consider the lease to be not valid and may rent the property to another party.



4. REQUIRED AGREEMENT:

   A signed rental Agreement is also due at the time of reservation. Unless a signed Agreement has been received and accepted by the Host, the Host may consider the lease to be not valid and may rent the property to another party.



5. SECURITY DEPOSIT:

   Security deposit is due at the time of reservation (unless held by a third party, e.g., Airbnb, TripAdvisor, etc.). The Host, entirely at Host’s discretion, is entitled to withhold funds from the Security Deposit to reimburse for damages to fixtures, furnishings, housewares, appliances, structures or other property. Funds may also be withheld to compensate Host for excess cleaning expenses. In the event that the funds in the Security Deposit are insufficient to recompense damages, Host reserves the right to collect additional funds from Guest. Host will return the Security Deposit (minus any funds owed for damage) within 7 business days of the departure of the Guest.



6. CANCELLATION/REFUND POLICY:

   Unless otherwise set by the platform on which the rental was booked (Airbnb, Travelocity, etc.), all accepted reservations are non-refundable for any reason. We are a small family business and when we accept a reservation, we remove that home from the market and can no longer accept bookings for it. Since we are prepared to honor your reservation, we expect you to honor it as well. Guests shall bear the financial burden of their changing travel plans regardless of reason, including but not limited to death or illness in the family, unforeseen work demands, illness of traveling party member, cancelation of wedding they had planned to attend, foul weather, canceled or delayed flights, pandemic, global or domestic terrorism, civil unrest, government imposed travel restrictions, loss of income, canceled conventions or meetings, inability to secure travel visas, family emergency, act of God, etc. All of the above applies to shortened stays in addition to canceled stays. In addition, in the event of a canceled booking, no refund will be due for other fees including but not limited to cleaning fees, extra guest fees, early check-in, late check-out fees, taxes or any other amounts paid. Given the strict nature of this cancelation policy, guests are encouraged to consider protecting their purchase with travel insurance, including "Cancel For Any Reason" insurance.

7. MAXIMUM OCCUPANCY:

   The maximum occupancy of this home is equal to the names listed in Section 2 above. This is inclusive of children of all ages. Additional guests are not permitted to enter the home at any time, except by express written consent of the Host.
   
   As discussed below under “Noise,” this home is not intended to be used to host parties or other social gatherings beyond the listed inhabitants.
   
   The above notwithstanding, we are generally permissive of daytime visitors by advanced request. Simply provide a list of visitor names (via email or text) more than 24 hours before their arrival for consideration and approval. Additional overnight guests beyond those listed above are subject to greater scrutiny and potential excess guest fees (depending on your earlier agreed occupancy level).

8. SMOKING:

   No smoking of any kind (including but not limited to tobacco, marijuana, and hookah) is allowed anywhere on the property, including any outside decks, patios, yards, staircases, or walkways. No tobacco products of any kind are to be used in the house, including but not limited to smokeless tobacco, pipes, chewing tobacco, or “dip.” Electronic cigarettes are not to be used in the home. The use of incense and candles is strictly prohibited.
   
   If you choose to smoke outside, please note that Washington State law prohibits smoking within a “minimum distance of twenty-five feet from entrances, exits, windows and ventilation intakes.” We ask that you respect our neighbors and not smoke near any residences. Furthermore, do not dispose of cigarette butts outside (including on the street,sidewalk or grassy medians).
   
   Evidence of smoking on the Property (including but not limited to cigarette butts found outside) may result in immediate eviction and forfeiture of all amounts paid. It may also result in substantial professional cleaning service costs to clean and fumigate the house, as well as other potential costs, which will be deducted from the security deposit and/or collected as an additional payment as outlined in Section 5.

9. PETS:

   No animals or pets of any kind may be brought onto the premises.



10. FIREARMS:

    No firearms shall be allowed on the premises.



11. FIREWORKS/HAZARDOUS MATERIALS:

    Guest agrees that fireworks and other hazardous materials shall not be used in or around the property.

12. USAGE RESTRICTIONS:

    • SUBLET: The Guest shall not sublet the property or any portion thereof.
    • END OF OCCUPANCY: Unless an extension is granted in writing by the Host, the Guest shall vacate the premises at the expiration time and date of this Agreement. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period.
    • TRANSIENT USE: Guest expressly acknowledges and agrees that this Agreement is for transient occupancy of the Property, and that Guest does not intend to make the property a residence or household.
    • MAIL/DELIVERIES: Except by prior arrangement with the Host, Guest may not receive mail or package deliveries at the property. Moreover, barring prior agreement by the Host, any mail or packages delivered to the property for the Guest that is received before the Guest's arrival or after the Guest's departure will be returned to sender, with no other effort made to deliver the materials to the Guest.
    • ILLEGAL ACTIVITIES: Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. is strictly prohibited.

13. SAFETY AND SECURITY:

    • PERSONAL INJURY/PROPERTY DAMAGE: The Guest and their visitors shall hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss.
    • INSURANCE: Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest, and that Guest should purchase their own insurance for Guest and their visitors if such coverage is desired.
    • ALCOHOL: Guest agrees that no one under the age of 21 shall consume alcohol on the property.
    • GAS APPLIANCES: Guest is advised that the property may contain a gas stove and cook top, gas heating, and other gas powered items and will seek help from management if the proper operation of such items is not fully understood. The property may include a gas/propane barbecue. The barbecue shall be operated by a responsible adult and shall never be left unattended. Do not use the barbecue close to the building or under an overhang.
    • FIRE EXTINGUISHER: The property has a fire extinguisher in the kitchen. The fire extinguisher was fully charged at last inspection. It is the duty of the guest to inform management immediately should the fire extinguisher become less than fully charged. Guest agrees to use the fire extinguisher only for true emergencies.
    • FIRE ALARMS: The property has smoke alarms installed and they are believed to function properly at the time of rental. Guest will notify management without delay if a fire alarm "chirps" or exhibits a low battery condition.
    • CARBON MONOXIDE ALARMS: The property has carbon monoxide alarms installed and they are believed to function properly at the time of rental. Guest will notify management without delay if a carbon monoxide alarm "chirps" or exhibits a low battery condition.
    • FIRST AID KIT: The property is equipped with a small, basic home first aid kit. Guest will notify management if any portion of the kit is used, so that it can be replenished as needed for subsequent guests.
    • LEFT PROPERTY: Seattle Vacation Home shall not be held responsible for items left behind by Guests. We will make reasonable efforts to return forgotten items to guests, subject to advanced payment of packing/shipping costs plus a $25 fee for the time required to retrieve, pack and ship items. The Host shall not be held liable for condition of left items. If items are not claimed within 6 months of departure, they shall become the property of the Host.
    • SECURITY: Guest shall see to their own security while in the property by locking doors, windows, and garage doors, etc. Guest shall take care to lock all doors and close the garage door when leaving the property.

14. RIGHT TO ENTER:

    The Host shall have the right to inspect the premises without prior notice at any time to enforce the terms of this Agreement. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately. The Host shall have the right to enter the premises at any time in order to complete urgent repairs or maintenance.



15. EXCESS CLEANING:

    The Guest shall maintain the premises in a good, clean, and ready to rent condition throughout the duration of the stay. Upon departure, the premises should be reasonably neat and clean. In the event that excess cleaning for ensuing guests is required, the expense for such cleaning will be deducted from the security deposit and/or collected as an additional payment as outlined in Section 5. Enforcement of excess cleaning charges will be at the sole discretion of the Host and the Host’s housekeeping staff.

16. PROPERTY DAMAGE:

    Guest shall pay for maintenance, repairs and/or replacement for damage occurring to furnishings, fixtures, appliances, structures, or other property during their stay.
    
    A few particular items of note:
    • Guests shall not move furniture from the position in which it is found. Some beds are not composed of solid wood and are particularly susceptible to damage if moved.
    • Guests are expected to notify Host of any pre-existing damage to property encountered upon arrival at the home within three hours of arrival.
    • In the event that property damage takes place, the expense for repair or replacement (at discretion of the Host) will be deducted from the security deposit and/or collected as an additional payment as outlined in Section 5. In the event that damage renders the Property in a condition that it cannot be rented as a high-end furnished rental for any length of time after Guest vacates the property, Guest will be liable for full reimbursement of lost rental income. Enforcement of damage collection will be at the sole discretion of the Host and the Host’s staff.

17. NOISE:

    This home is situated in a family friendly residential neighborhood. It is not a suitable venue to host social gatherings beyond the agreed upon occupancy of the home. (Note Section 7 above concerning maximum occupancy.) At all hours, outdoor noise should be kept to a minimum and indoor noise shall be such that it cannot be heard in adjacent homes or outside the home. For the purposes of this Agreement, "quiet hours" are defined as 24 hours per day. The Guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding residents. The Guest shall not create noise or disturbances likely to disrupt or annoy the surrounding residents. Creating a disturbance of the above nature shall be grounds for immediate termination of this Agreement and Guest shall then immediately vacate the premises.
    
    Guest understands and agrees that the rental home may be equipped with "Noise Aware" noise sensors. These devices monitornoise levels at the property, but do not record actual audio. The sensors are located in common living areas (not bedrooms or bathrooms) and are programed to our definition of quiet hours (24 hours) and to a sensitivity level of "high."     The strict application of this section with regard to noise is non-negotiable, and Host will have zero tolerance for disruptive behavior. Determination of appropriate noise levels will be at the sole discretion of the Host, with strong weight given to input of the neighboring residents.
    
    Guests with any concern that the terms of this Section will create an issue are to raise their concern immediately to the Host so that alternative accommodations may be pursued.

18. EXTERIOR VIDEO MONITORING:

    The host may use exterior security cameras to monitor activity outside of the home. No cameras are located to record the interior of the home

19. CHECK-IN:

    The period of occupancy shall begin at 4pm on the day of arrival, unless otherwise agreed upon by the parties.



20. CHECK-OUT:

    The period of occupancy shall conclude by 11am on the day of departure, unless otherwise agreed upon by the parties. By the time of check-out, the premises shall be vacated by Guest, with all of Guest’s personal property removed.



21. SUBSTITUTION:

    If the Property is not habitable or is otherwise not available at the time of the check in, the reservation will be cancelled without penalty to the Host, and all monies paid will be fully refunded with no additional remedy. Whenever possible, the Host will offer to substitute a home of equal or larger size and sleeping capacity, within 2.5 miles of the Property. If the Guest chooses to decline this substitution, Guest will be entitled to a full refund of all monies paid, and no other remedy. If the substitute Property is agreed upon by both parties, all terms of this Agreement shall apply to the substitute Property without revising the Agreement.


22. Host shall provide towels, linens and housewares as commonly found in furnished vacation rentals.


23. We occasionally experience outages (of Internet, water, cable, gas, electric, etc.) that are beyond our control. Please report any outages to the Host. We report outages to the relevant service provider and seek resolution as quickly as feasible. No refunds or compensation will be given for any outages.


24. Guest agrees not to access the “hosts’ closets” or other storage areas, even if unlocked, which contain household goods, personal articles, cleaning supplies and chemicals that could be hazardous to children and adults.



25. MARKETING/PRIVACY:

    By submitting to this agreement, you may periodically receive email, text, mail or phone calls from Seattle Vacation Home. You may opt out at any time. Seattle Vacation Home will never provide your contact information, or any information concerning your stay, to any third party unless required by law.


26. Guest agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Host enforcing this Agreement.



27. FORUM SELECTION:

    The parties agree that all actions or proceedings arising in connection with this Agreement shall be tried and litigated exclusively in the State and Federal courts located in the County of King, State of Washington. The aforementioned choice of venue is intended by the parties to be mandatory and not permissive in nature, thereby precluding the possibility of litigation between the parties with respect to or arising out of this Agreement in any jurisdiction other than that specified in this paragraph. Each party hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph, and stipulates that the State and Federal courts located in the County of King, State of Washington shall have in personal jurisdiction and venue over each of them for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Agreement.
